Danny Merlin joined Alexander Ricks PLLC as a Member in 2015 and specializes in commercial real estate transactions, zoning and land use, financial services, and real estate and title claims litigation. Danny represents a variety of parties involved in real estate transactions, including lenders, developers, tenants, landlords, buyers, sellers and contractors. He has significant experience with a wide assortment of projects such as retail (single tenant and multi-tenant), multi-family, office, and neighborhood developments, among others. He also regularly assists clients in closing construction loans, term loans, lines of credit, acquisition and development loans and asset-based loans. Often, Danny helps clients with business transactions, including creation, organization, dissolution, mergers and acquisitions, corporate finance and joint ventures.

Danny also has substantial commercial litigation experience in which he has represented title insurance companies and their insureds in all manner of title insurance claims. Such claims included resolution of access, easement and boundary issues, lien priority disputes, mechanics’ lien defense, defalcation and fraud claims, and coverage opinions. Danny’s title insurance litigation experience serves as the perfect complement to his real estate practice and allows him to help his clients avoid the pitfalls of the title insurance claimants he encounters in litigation.

Danny serves his community in a number of ways. He is on the Executive Committee (Treasurer) of the Mecklenburg Bar Foundation, the Mecklenburg County Bar’s charitable arm. He is a member of the Board of Governors of the North Carolina Bar Association, is on the Board of Directors of the Biddleville Smallwood Community Organization, is a Board Member and General Counsel for Music Over Mind, Incorporated (a nonprofit dedicated to helping those with mental illness through music), and is a passionate member of F3, a men’s workout group focused on invigorating male community leadership. He is the past Chair of the Mecklenburg County Bar’s Young Lawyers Division, was an Associate Member of the Graduate Faculty at UNCC (teaching Legal Environment in Business courses), and was previous Chair of both the Mecklenburg County Bar Leadership Institute and the North Carolina Bar Association’s statewide 4ALL Service Day.

Recent Transactions:

  • Represented lender on a $60MM construction loan to a developer constructing a 300,000 square foot 18 story multi-tenant office building located within an expansive mixed-use development
  • Represented real estate investment manager in purchasing residential neighborhoods under development, completing infrastructure and selling lots to builders
  • Represented retail developer in purchasing former elementary school property from local municipality, negotiating multiple leases with national tenants, including major anchor tenant, and closing construction loan for demolition and improvements to property
  • Represented developer in closing on purchase of property and construction loan for development of 250 unit apartment complex in greater Charlotte metropolitan area
  • Created multiple companies, including drafting and filing Articles of Organizations, negotiating Operating Agreements, and preparing related contracts for single-tenant developments
  • Prepared organizational documents and obtained approvals for the creation of North Carolina dental practice with multiple locations; negotiated purchase contracts, employment agreements, operating agreements, and numerous related documents
